Do you need a building permit for your swimming pool?
Good news to start with: for a typical garden pool next to a detached house, the answer is usually no. The new Building Act (Act No. 283/2021 Coll.) classifies smaller swimming pools at detached houses and buildings for family recreation as minor structures that do not require a permit or notification. However, exceptions always exist, which it is advisable to consider before the excavator starts digging.
Basic rule: up to 40 m² without a permit
An in-ground pool at a detached house generally does not require any procedures with the building authority, provided that:
- its area does not exceed 40 m² (a 7×3 m pool has 21 m², an 8×4 m pool has 32 m²: both meet the requirement with a margin),
- stands on the plot of a family house or a building for family recreation and is connected with residential use,
- is located at a distance of at least 2 metres from the property boundary.
The limit includes the swimming pool's water surface; the technical shaft is usually considered part of it. However, if you are also building a pool house or larger paved areas alongside the pool, these are assessed separately.
When you cannot do without the authorities
- Swimming pool larger than 40 m² - then it is a construction requiring a permit.
- A setback of less than 2 m from the property boundary - requires resolution with the authority, typically also with the neighbour's consent.
- Conservation zone or reserve - A heritage authority statement is required regardless of the pool's size. In historic parts of municipalities in the Central Bohemian Region, you will encounter this more often than expected.
- Protection zones - water supply and sewer lines, electrical cables, gas pipelines, protected landscape areas (CHKO). A utility network statement is always obtained before excavation begins.
- Well or private water source - Filling from a private well may exceed permitted withdrawal limits for larger pools.
Filling the pool: do not forget to contact the water utility company.
This is not related to the permit but surprises almost everyone: filling the first approximately 30 m³ of water from the mains all at once may not be a good idea. Rapid draw-off stirs up sediment in the water supply pipe, and cloudy water may arrive, waterworks recommend filling slowly, ideally overnight, or alternatively ordering water delivery by tanker.
What this means in practice
- Pool up to 40 m² and 2 m from the fence at a detached house: you can build without official approval.
- Anything beyond these rules: allow an extra few weeks for utility network statements and permits.
- The utility network statement and assessment of site conditions should be provided by the construction company as part of the offer, ask for it; this is one sign of a reputable pool builder.
